Common Injuries That Can Be Caused by an Indianapolis Car Accident:
Neck Injuries: Neck injuries are among the worst injuries that happen in car accidents. Although a neck injury like whiplash is sometimes viewed as a minor nuisance, it can be excruciatingly painful with a long recovery period. Neck injury symptoms can arise hours, days, or even weeks after an accident.
Soft Tissue Injuries: Soft tissue injuries are a common outcome of a Indianapolis car accident, encompassing damage to muscles, tendons, and ligaments throughout the body. These injuries often result from the abrupt force and sudden deceleration experienced during a collision.
Contusions: Contusions, commonly known as bruises, are a frequent consequence of a collision, particularly those involving sudden impacts or collisions. These injuries occur when the body’s soft tissues are subjected to forceful contact with hard surfaces, such as the steering wheel, dashboard, or other interior components of the vehicle.
Fractures: The impact of car crashes, whether from direct contact with parts of the vehicle or sudden deceleration, can lead to fractures in the limbs, ribs, pelvis, or other skeletal structures. Fractures can significantly impact an individual’s mobility, causing pain, swelling, and restricted movement.
Back injuries: Back injuries are a common and potentially debilitating outcome of accidents, given the complex structure of the spine and the substantial forces involved in car collisions. The sudden impact or abrupt deceleration during a crash can cause a range of back injuries, including sprains, strains, herniated discs, and fractures. It’s important to seek medical treatment immediately not just for your health but also for your car accident case.
Concussions: Concussions may not always present immediate symptoms, and individuals involved in car accidents might experience confusion, dizziness, headaches, or memory problems over time. Seeking prompt medical attention is crucial, not only for the well-being of the individual but also for legal and insurance considerations.
Traumatic brain injuries: Traumatic brain injuries from Indiana car accidents are serious and can have long term implications. Symptoms can often to delayed and recovery can be long and challenging. Headaches, dizziness, memory loss, and changes in mood or behavior as just a few of the symptoms someone can have after a car crash.
Crush injuries: Crush injuries occur when a body part is subjected to severe pressure or compression between two objects, such as the interior of a vehicle and external structures like the dashboard or doors. The force generated during a collision can lead to fractures, lacerations, and damage to underlying tissues and organs.
Internal bleeding: Internal bleeding is a serious and potentially life-threatening consequence of car accidents, often resulting from the blunt force trauma sustained during a collision. The impact of a car wreck can cause blood vessels, organs, or tissues to rupture, leading to internal bleeding that may not be immediately apparent.
Organ damage: The internal organs most commonly affected include the spleen, liver, kidneys, heart, and lungs. Symptoms may not immediately manifest, and individuals involved in a car accident may experience pain, swelling, or internal bleeding over time.
Chemical and heat burns: In the event of a car crash involving vehicles carrying combustible materials or hazardous chemicals, the risk of chemical burns or fire-related injuries increases significantly.

Aren’t Car Accidents in Indianapolis Just Accidents?
An experienced car accident lawyer knows that car accidents are very rarely “accidents” with no liable party. In almost every car crash, someone is responsible for causing the car collision through negligence, recklessness, or carelessness. As an experienced car accident law firm, an Indiana auto accident lawyer sees too many people who don’t protect their rights.
People in car accidents often get stuck with significant hospital bills and wages that should have been covered by the other driver’s insurance company. The injured person didn’t file a claim or hire one of Indiana car accident lawyers and most don’t even know their rights.
Your own health insurance provider may refuse to pay your doctor bills because they were caused by an auto accident someone else was responsible for, but our Indiana car accident lawyers can help you stand up to the health insurance company.
Common Causes of a Car Accident in Indianapolis
- Driver Error — Driver error is the most common cause of motor vehicle accidents in Indianapolis. When drivers are reckless or negligent, crashes occur. Common examples of driver error include distracted driving, DUI car accident, drowsy driving, speeding, drugged driving, following too closely, and violations of other traffic laws.
- Defective Products — Defective car parts and defective systems can lead to Indiana car accident. If the brakes are defective or a tire is defective, the driver may lose control of the vehicle. When a defective product is a factor in a crash, the manufacturer may be held liable for damages.
- Poor Weather Conditions — Fog, wind, rain, sleet, snow, and other weather conditions can be a factor in a car accident. However, drivers are also at fault when they fail to reduce their speed or take other measures to reduce the risk of a car accident.
- Hazardous or Dangerous Road Conditions — In some crashes, road conditions may be a contributing factor to the cause of the crash. Missing or malfunction traffic signals, defectively designed roads, missing guardrails, inadequate signage, overgrown foliage, and improper road maintenance can be factors in a crash.
How Can I Prove My Car Accident Case Isn’t My Fault?
It is important for one of Poynter & Bucheri’s experienced Indiana personal injury lawyer to determine the cause of the crash because Indiana is a fault insurance state for car accident claims.
In other words, you must prove that the other party was “at fault” in the Indianapolis car accident to recover maximum compensation for your injuries and damages.
In some Indianapolis car accidents, it is easy to determine fault. For instance, a driver turns left in front of another vehicle or a driver runs a red light. In these car accident cases though, it should be clear that the driver who violated traffic laws was at fault for the crash. You may think it’s so obvious you don’t need an Indianapolis car accident lawyer.
However, the other driver’s insurance company won’t enjoy paying fair settlement amounts for personal injury claims. Especially when the accident causes serious injury and victims accumulate serious medical expenses. Therefore, some insurance companies and adjusters (even from your own insurance company representative ) may initially deny valid claims by disputing fault.
Our Indianapolis car accident lawyers work quickly to obtain evidence from the car accident scene. We that proves the other driver or another party was at fault for the car crash or motor vehicle accident itself. Our law firm strives to quash any claim the driver’s insurance company may try to make that prevents you from recovering full compensation for all damages.
Evidence We Collect to Establish Fault for a Car Crash Include:
- Evidence from the car accident scene, including photographs, videos, and physical evidence
- Physical evidence from the vehicles involved in the crash
- Copies of your medical records, doctor’s statements and medical bills
- Statements from eyewitnesses
- Copies of the police accident reports
- Video or images taken at the car accident scene
- Name and contact information for the injured party (or parties)
In complex cases in which fault may be disputed, our team of car accident attorneys in Indianapolis may retain experts, including car accident reconstructionist or engineers, to help establish the cause of the collision and identify the responsible party.
How Much Money is My Car Accident Claim Worth?
The value of a car accident claim depends on several factors, including the grounds for your personal injury lawsuit, the type and severity of your injuries and the financial losses incurred because of the crash. There are two types of damages in a car accident claim include economic damages and non-economic damages.
Economic Damages
Economic Damages that you may seek compensation for include damage to property, cost of medical treatment, missed wages, travel expenses, medical equipment, physical therapy, medications, and other out-of-pocket costs. (Keep all of your medical bills. You’ll need to give those to your Indiana car accident lawyer so they can determine the correct amount for your personal injury lawsuit.)
In addition to the total of economic losses, a car accident victim is also entitled to pain and suffering or non-economic damages, but you typically need an experienced accident lawyer to get the amount you deserve.
Non-Economic Damages
Non-economic damages are intended to compensate a victim for the pain and suffering caused by the car accident. Your physical pain, loss of enjoyment of life, emotional stress, permanent impairments, and mental anguish are included in this category of damages.
It can be very difficult to place a value on a person’s pain and suffering. Because Indiana’s personal injury laws do not contain a formula for calculating pain and suffering damages, you need Indianapolis’ experienced auto accident attorney to establish the value of your claim.
It’s highly likely your damage claims will be challenged by insurance adjusters from other insurance companies involved in the injury claim and you’ll want one of our Indiana car accident lawyers on your side.
Each Indianapolis car accident attorney of Poynter & Bucheri, LLC understands how to use the evidence in car accident cases to arrive at a fair and just amount for pain and suffering damages. Our personal injury lawyers use the evidence and your statements to justify the maximum amount of compensation for non-economic damages.

What if The At Fault Driver is Uninsured or Underinsured?
If you are involved in a car accident with an uninsured driver and sustain a serious injury, the responsibility for covering your damages may fall on various sources, depending on the specific circumstances and the insurance coverage available to you.
Potential sources of payment include:
Your Uninsured Motorist Coverage: If you have uninsured motorist (UM) coverage as part of your auto insurance policy, this coverage is designed to protect you in situations where the at-fault party is uninsured. Your insurance company would then step in to compensate you for medical expenses, lost wages, and other damages up to the limits of your policy.
Health Insurance: Your medical insurance may cover some of your medical bills resulting from the accident. In many cases, it can be utilized to cover immediate medical costs, but it’s essential to be aware that health insurance does not typically cover non-economic damages such as pain and suffering.
Personal Savings or Assets: If you do not have uninsured motorist coverage or health insurance, you might have to rely on personal savings or assets to cover your expenses. However, this can be financially challenging, especially in the case of serious injuries that result in high medical bills and ongoing rehabilitation costs.
Legal Action Against the Uninsured Driver: You may consider pursuing a personal injury lawsuit against the uninsured driver to recover damages. However, if the driver does not have insurance, they may not have sufficient assets to cover your expenses, making the recovery process challenging.
It’s advisable to consult with an experienced personal injury attorney to evaluate your specific situation and explore the best course of action. They can help you navigate insurance claims, assess available coverage, and guide you through any legal proceedings if necessary.
How Long Will It Take to Get My Car Accident Settlement?
Settlements can take months, or even years to negotiate, especially if you were in a serious accident with a large personal injury claim amount. But once you and your injury lawyers have accepted the settlement, you’ll typically receive your money within a few months.
The duration hinges on factors such as the nature of the case, whether it involves a car accident or another incident resulting in serious injuries.
Before the victim receives their settlement check, several steps happen:
- Initial payments cover victim expenses, including medical and vehicle repair bills.
- Once these are settled, attorney fees, court costs, and filing fees are addressed.
- The final step involves issuing a check to the plaintiff after deducting all related bills, fees, and expenses. The overall process usually takes a few weeks, but may be longer if there are a large number of payouts to be made.
I Want The Money Faster, Can I Get an Advance?
When it comes to obtaining an advance on a personal injury settlement, caution is advised. While some law firms offer this option, potential risks exist. Personal injury lawsuits are inherently unpredictable, and losing the case means repaying any advance received, creating financial challenges.
Furthermore, unfavorable terms, such as high fees or interest rates, can erode the settlement amount. Alternative options for financial assistance during the settlement period include negotiating payment plans with medical providers, borrowing from friends or family, or exploring loans or lines of credit with favorable terms.
Before opting for an advance, it’s best to carefully assess the risks and long term costs while exploring other available avenues.

Hi, I’m Rich Bucheri from Poynter & Bucheri. And today, I want to talk about how to make an auto accident insurance claim. So the first thing that I would say is if you’re involved in an accident, it’s very important that you exchange insurance information with the person that hits you, and try to get that information at the scene of the accident. Sometimes they make you wait until the police report comes out, but that can take days or I’ve even seen weeks in order to do that. And you really want to try to get these auto claims set up right away, especially if your car had to be towed and is incurring storage charges or you’re incurring rental car charges. You want to make sure that this process gets going as quickly as possible.
Now, I would say caveat, consider contacting an attorney to do all this for you because when you are setting up your claim, you’re going to be asked questions and things of that nature. And you may want to make sure that you’re getting all this information correct because you don’t want to say anything during the time that you’re setting up your case that’s later going to compromise your case. But when you are setting this up yourself, you need to make sure that you get their insurance company and get your insurance company information together. Make sure that you’re going to be contacting the claims department of each of the insurance companies. Sometimes you’re going to be on hold for 20, 30, 40 minutes or so. But you need to make sure that you can do that. Sometimes, insurance companies have online portals where you can set up the claims online. And so you can take advantage of that.
When you do finally get ahold of somebody, make sure that you have all the facts ready. They’re going to be looking for the date, the time, the location. And they’re going to want to know all the details about your vehicle. I would be hesitant to give a formal recorded statement about how the accident actually happened or the nature and extent of your injuries until you’ve had time to prepare for that. And again, I would ask that you consider contacting an attorney because it’s always a good idea to have an attorney prepare you before you’re giving a formal statement about what happened in an accident.
